Plain-language rules for using our public website. Project-specific terms belong in the contract we agree together.
About these terms
These terms govern access to and use of willsoft.co.ke. The website is operated by WILLTRUTH SOFT SYSTEMS & TECHNOLOGIES LTD, a private limited company operating in Kenya and trading as Willsoft Technologies (“Willsoft”, “we”, “us” or “our”).
By using the website, you agree to these terms. If you do not agree, please stop using it.
Website information
The website presents general information about our company, capabilities, portfolio and perspectives. It is not professional, legal or financial advice, and it is not by itself a binding offer to deliver services.
We aim to keep information accurate and useful, but examples, availability, timelines, technologies and service descriptions may change.
Client services and contracts
Software development, design, consulting, support and related work is governed by the proposal, statement of work, master services agreement or other written contract agreed with the client. If that agreement conflicts with these website terms, the signed client agreement controls for that engagement.
Quotes, fees and payment
Website content does not establish a fixed quotation. Scope, deliverables, fees, taxes, expenses, invoicing, payment dates, change requests, cancellation and any refund rights will be stated in the applicable proposal or client agreement. We do not promise a general refund period unless it is expressly agreed in writing or required by law.
Acceptable use
You must not use the website to break the law, infringe another person’s rights, transmit malicious code, attempt unauthorised access, disrupt the website, scrape it in a harmful or excessive manner, impersonate another person, or submit unlawful, deceptive or abusive material.
Intellectual property
The website, brand, copy, visual system, software demonstrations and other materials are owned by or licensed to Willsoft and are protected by applicable intellectual-property laws. You may view and share links for legitimate personal or business evaluation, but may not reproduce, sell, modify or exploit substantial website content without written permission.
Ownership and licensing of deliverables created for a client are determined by that client’s written agreement.
Information you submit
You confirm that you are entitled to send us any enquiry, brief, files or other material you submit. You retain ownership of your material and permit us to use it only as reasonably necessary to evaluate your request, communicate with you and provide agreed services. Personal data is handled under our Privacy Policy.
Third-party services and links
The website may link to third-party websites or rely on third-party infrastructure. We do not control their content, availability or privacy practices. A link does not necessarily mean endorsement, and your use of a third-party service is governed by its own terms.
Availability and warranties
We work to keep the website secure and available, but it may occasionally be interrupted, changed or withdrawn. To the extent permitted by law, the website is provided on an “as available” basis without warranties not expressly stated here. Nothing in these terms excludes a warranty or consumer right that cannot lawfully be excluded.
Liability
To the extent permitted by Kenyan law, Willsoft is not responsible for indirect or consequential loss arising solely from reliance on, or inability to access, this public website. Nothing here limits liability that cannot legally be limited, including liability arising from fraud or wilful misconduct. Liability relating to paid client services is governed by the applicable client agreement.
Suspension and changes
We may restrict access where reasonably necessary to protect the website, users, our systems or legal rights. We may update these terms as our website, operations or legal duties change. Updated terms apply from the effective date shown here and do not retrospectively rewrite an existing signed client agreement.
Governing law and disputes
These website terms are governed by the laws of the Republic of Kenya. We encourage you to contact us first so a concern can be resolved in good faith. Subject to any mandatory rights or an applicable written client agreement, the courts of Kenya have jurisdiction over disputes concerning these website terms.
